On May 1, 2026, IRCC clarified its policy on restoration of temporary resident status.
Under section 182 of the IRPR:
👉 If your status expires (including after a refusal), you generally have 90 days to apply for restoration
👉 You can apply from inside Canada and you do NOT need to leave
But here’s what many people misunderstand:
Restoration is not limited to your previous status.
A former:
• Worker
• Student
👉 May restore as a visitor if work or study is no longer viable
Important restrictions (often overlooked):
âť— You cannot work or study while your restoration is in process
(authorization only resumes after approval and issuance of a new permit)
âť— If you leave Canada, your restoration application is effectively abandoned/refused (restoration is an in-Canada process only)
âť— You only get one 90-day window
Why this matters
With this clarification, it creates a real fallback:
Instead of leaving Canada or filing a weak application,
you may restore status as a visitor and reassess your options.
But be careful
You are not restoring to multiple statuses.
You are making one restoration request with possible outcomes.
Bottom line
Restoration offers flexibility but it is time-sensitive and unforgiving if used incorrectly.
Understanding the distinction between:
• restoration vs. extension
• status vs. authorization
• and primary vs. fallback requests
can make the difference between staying in Canada legally… or not.
